1. Overview & Our Commitment
At Ecoride, we are committed to providing safe, reliable, and sustainable transportation and delivery services. Integral to this mission is our unwavering commitment to protecting the privacy and security of our users' personal information. This Privacy Policy outlines how Ecoride ("we," "us," or "our") collects, uses, discloses, and safeguards the information you provide when using our mobile application, website, and services (collectively, the "Services") in accordance with the Data Protection Act, 2024 of the Laws of Malawi. The Platform is committed to ensuring that personal data is processed lawfully, fairly, transparently, and securely.
In compliance with the Data Protection Act, user data shall be processed in accordance with the following principles: Lawfulness, fairness, and transparency; Purpose limitation; Data minimization; Accuracy; Storage limitation; Integrity and confidentiality; Accountability
2. Data We Collect and How We Use It
We collect data to provide, improve, and personalize our Services, ensure safety, and comply with legal obligations.
a. Information You Provide Directly
- Account Information: Name, email address, phone number, profile photo, and payment information (handled by secure, PCI-compliant processors).
- Service Details: Pick-up and drop-off locations, delivery instructions, recipient contact information, and contents/values for delivery items (where required for insurance or special handling).
- Communications: Records of your interactions with our customer support, drivers, or couriers.
b. Information Collected Automatically
- Location Data: Precise real-time and background location (when the app is in use) is essential for matching you with nearby drivers, tracking your ride or delivery, ensuring safety, and analyzing traffic patterns. You can control location permissions through your device settings.
- Device & Usage Information: IP address, device type, operating system, app crashes, unique device identifiers, and information about how you interact with our Services (e.g., pages viewed, features used).
- Trip/Delivery Data: Date, time, distance, route, fare, driver/courier details, and ratings you provide.
c. How We Use Your Information
- To Provide Core Services: To facilitate and fulfill your transportation and delivery requests, process payments, and communicate trip/delivery status.
- For Safety & Security: To verify user identities, conduct background checks on drivers/couriers (where applicable), and investigate and prevent fraudulent or unsafe activities.
- To Improve & Personalize: To develop new features, perform analytics, and personalize your experience (e.g., suggesting frequent destinations).
- For Communication: To send you service-related announcements, transactional receipts, support messages, and (with your consent) promotional offers and updates.
- For Legal & Compliance: To comply with legal obligations, resolve disputes, and enforce our Terms of Service.
3. Legal Basis for Processing
The Platform processes personal data on one or more of the following lawful bases as recognized under the Data Protection Act, 2024:
- Consent of the user
- Performance of a contract to which the user is a party
- Compliance with a legal obligation
- Legitimate interests of the Platform, provided such interests do not override the rights and freedoms of the user
4. Consumer Consent and Trust: Your Choices and Rights
Your trust is paramount. We are committed to giving you control over your personal data.
a. Providing and Withdrawing Consent
- By creating an account and using our Services, you consent to the collection and use of your personal data as described in this policy and under the Data Protection Act, 2024.
- Marketing Communications: You will only receive promotional emails and push notifications if you explicitly opt-in. You can withdraw this consent and opt-out at any time via the "Unsubscribe" link in emails or through your app notification settings.
- Location Services: You provide consent for location data collection when you enable location permissions for the Ecoride app on your device. You can change this at any time in your device settings, though disabling may limit core service functionality.
b. Your Data Protection Rights
Depending on your location, you may have the following rights regarding your personal data:
- Right to Access & Portability: Request a copy of the personal data we hold about you in a structured, machine-readable format.
- Right to Correction: Request correction of inaccurate or incomplete personal data.
- Right to Deletion: Request deletion of your personal data under certain circumstances (subject to legal retention requirements for safety, fraud, or financial record-keeping).
- Right to Object/Restrict Processing: Object to or restrict our processing of your data, particularly for direct marketing.
- Right to Withdraw Consent: Where we rely on consent, you may withdraw it at any time without affecting the lawfulness of processing based on prior consent.

c. Building Trust through Security & Transparency
- Data Security: We implement robust technical and organizational measures, including encryption, access controls, and secure cloud infrastructure, to protect your data from unauthorized access, loss, or misuse.
- Data Sharing & Disclosure: We do not sell your personal data. We only share it with trusted third parties as necessary (e.g., drivers/couriers to complete your trip, payment processors, cloud service providers, legal authorities when required). All third parties are contractually obligated to protect your data.
- Data Retention: We retain your personal data only for as long as necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required or permitted by law.
- Children's Privacy: Our Services are not intended for individuals under the age of 16. We do not knowingly collect data from children.
- Policy Updates: We may update this policy periodically. We will notify you of material changes via the app or email and will post the updated policy with a new "Last Updated" date.
5. Cross-Border Data Transfers
Where personal data is transferred, stored, or processed outside the Republic of Malawi, such transfer shall be undertaken strictly in compliance with the Data Protection Act, 2024 and only where lawful safeguards ensuring an adequate level of protection of personal data are in place.
In particular, Ecoride, as a data controller, and any appointed data processors shall not transfer personal data from Malawi to another country or to an international organization unless one or more of the following conditions are satisfied:
a. The recipient of the personal data is subject to
- i.a law;
- ii.binding corporate rules;
- iii.a personal data protection contractual clause;
- iv.an approved code of conduct; or
- v.a recognized certification mechanism,
Which affords an adequate level of protection for personal data in accordance with the standards prescribed under the Data Protection Act, 2024; or
b. One or more of the lawful conditions permitting cross-border data transfers, as prescribed under the Data Protection Act, 2024, applies
Ecoride shall ensure that any cross-border transfer of personal data is limited to what is strictly necessary for the performance of its services and that appropriate technical and organizational safeguards are implemented to protect such data against unauthorized access, loss, or misuse.
In accordance with the Data Protection Act, 2024, Ecoride shall maintain written records documenting the legal basis and justification for any transfer of personal data from Malawi to another country or international organization, and such records shall be made available to the relevant regulatory authority upon lawful request
6. Indemnity for Unauthorized Data Breach
The user acknowledges that despite the Platform’s implementation of reasonable technical and organizational security measures, no electronic data transmission or storage system is completely secure. Accordingly, Ecoride shall not be held responsible for data breaches arising from unforeseen circumstances, including but not limited to criminal hacking, cyber-attacks, malware, or unauthorized third-party intrusion beyond the reasonable control of the Platform.
To the fullest extent permitted by law, the user agrees to indemnify and hold harmless Ecoride, its directors, officers, employees, agents, and affiliates from and against any claims, losses, damages, liabilities, costs, or expenses arising from or connected to the misuse of user data caused by such unlawful third-party acts, provided that Ecoride has not acted negligently or in wilful disregard of its statutory obligations.
7. Limitation and Denial of Liability for Data Leakage
Without prejudice to mandatory provisions of the Data Protection Act, 2024, Ecoride disclaims liability for any loss, damage, or harm suffered by a user as a result of unauthorized access, disclosure, alteration, or loss of personal data caused by circumstances beyond the Platform’s reasonable control, including criminal cyber activities.
Ecoride shall not be liable for indirect, incidental, consequential, or punitive damages arising from data leakage, loss of profits, reputational harm, or emotional distress, whether arising in contract, depict, or otherwise, save where such liability is expressly imposed by law.
Nothing in this provision shall exclude or limit liability where such exclusion or limitation is prohibited under applicable Malawian law.
8. Disclaimer
Ecoride provides its services and digital platform on an “as is” and “as available” basis. While every reasonable effort is made to protect user data and maintain system integrity, Ecoride makes no warranty, representation, or guarantee that the Platform will be free from security vulnerabilities, interruptions, or unauthorized access at all times.
Users acknowledge and accept that the use of digital platforms inherently carries certain risks and agree to use the Ecoride application at their own discretion. Ecoride expressly disclaims all warranties, whether express or implied, including warranties of uninterrupted service, absolute data security, or fitness for a particular purpose, to the extent permitted by law.
9. Amendments to this Policy
The Platform reserves the right to amend this Policy to ensure continued compliance with applicable laws. Users shall be notified of material changes through the application or other appropriate communication channels.
10. Governing Law
This Policy shall be governed by and construed in accordance with the laws of the Republic of Malawi, including the Data Protection Act, 2024.
